Know all men by these presents that I John Turnham sen (Senior) of the county of Shelby and State of Kentucky being of perfect mind and memory calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make & ordain this my last will and testament this is-First and principally I give demise and bequeath unto Elsey Turnham my beloved wife all my estate both real and personal consisting of lands house tenements Negroes and stock of every description and also all the money now in my possession or due me by note or account after paying my lawful debts also all grain produce and farming interest belonging to my estate to have and to hold the same to her own proper use and benefit to manage give use and dispose of the same during her life as she may think proper but to my lawful heirs provided however that each heir receive no more than his or her equivolent (sic) part of my estate. At her death I wish my property to be equally divided amongst all my children except my daughter Frances married to Hiram Holloway-the heirs of my daughter Betsey married to William James and deceased-my daughter Elcey Beula married to John Turnham-my daughter Ellen married to Joel Turnham and my son Josephus. I wish my wife to administer unto Frances Holloway such a portion of my estate as she may think best and at Frances death if she have no heir the same to revert to my lawful-the heirs of my daughter Betsey I wish to receive no more of my estate as I have already given to her all I intend---from the portion coming to my daughter Elcey Beula, I wish five hundred and thirty four dollars deducted and then she shall receive an equivolent part with my other children-from the part coming to my son Josephus I wish one thousand dollars deducted and then he shall have his equivolent with the other heirs-to my daughter, Ellen, I will and bequeath fifty dollars to be paid now and I leave it discretionary with my wife whether she receive any more or not.
I also constitute make and ordain my wife Elcey Turnham and my son John Turnham, executrix and executor of this my last will and I do hereby utterly revoke and disallow of all other wills and testaments by me in any wise made or named confirming this to be by last will and testament In testimony whereof I have hereunto set my hand & seal this first day of April 1833.
