Benjamin W Smithson [Parents] was born in 1803/1804 in , Lunenburg, Virginia. He died on 25 Mar 1861 in , Clintonville, , Missouri. He married Mary J Fenley on 10 Oct 1832 in , Bedford, Tennessee.

!Notes:
Benjamin W. Smithson would have been over 30 years old at the time
of his
father's death in 1837, thus not a minor child at the time of his
mother's
death in 1838/39.
A Benjamin W. Smithson was a witness to the will of Aaron Finch.
Will was
dated 9 May 1846 and entered for probate in Polk Co. MO.
His pension record states that Capt. Benj. W. Smithson of Bolivar,
Polk Co.,
MO left home in year of 1847 in command of a Company of soldiers for
the Mexican
War. Adjutant General's Report showed that he enlisted 23 Jul 1848
at Taos, MO.
Company was mustered out 21 Oct. 1848 at Independence, MO.
He caught "measels" while in the army and died 25 Mar. 1861. He
was last
treated by Dr. Thornton of Clintonville, MO at that time. His
widow, Mary J.,
eventually succeeded in obtaining a pension in 1887 when the law was
changed
that would then make her eligible.
He also had been granted a Bounty Land Warrant.

Benjamin W. Smithson
[To accompany bill H. R. #630]
December 19, 1856
Mr. Buffington, from the Committee on Military Affairs, made
the following
REPORT.
The Committee on Military Affairs, to whom was referred the
memorial of
Benjaming W. Smithson, respectfully report:
The evidence in the case shows that Benjamine W. Smithson
was captain
of Company K, in the third regiment of Missouri mounted
volunteers; that
he entered the service of the United States in 1847 to serve
during the
Mexican war; that he was marched to New Mexico with his
regiment and
stationed at Taos; that on the 31st of October Captain Smithson
tendered
his resignation to Colonel Newby, of the Illinois volunteers,
then in
command of that military department; that, after this, Captain
Smithson
continued in command of his company, by order of Colonel Newby,
until his
resignation was accepted by the Secretary of War, it having
been sent by
Colonel Newby to the Adjutant General, who submitted the same
to the
Secretary of War, with a recommendation that Captain Smithson
be dis-
charged, to take effect from the 1st of November, the day after
the date
of registration. This recommendation was approved by the
Secretary of
War, and communicated, by the Adjutant General, to Colonel
Newby in a
letter dated January 4, 1848. Captain Smithson remained in his
command at
Taos until the order of the Adjutant General was communicated
to him by
Colonel Newby, which was about the 1st of April, 1848. The
committee are
of the opinion that an order from the Secretary of War could
not take
effect in New Mexico two months before the date of same at
Washington,
four months before the reception of same in New Mexico. Such a
thing is
impossible, and should not weight, in the opinion of the
committee,
against the payment of Captian Smithson for the time he
remained in the
army, between the date of his resignation and the reception of
its
acceptance. The committee acordingly report a bill.

Mary J. was age 30-40 in 1840 census; age 35 in the 1850 census
and age 81
years, 3 months and 7 days old when she died. She was probably born
20 Nov.
1810, if the stone was properly read and recorded.
