In the name of God Amen. I Bird [sic] Link of the County of Haywood of State of Tennessee do make and publish this my last will and testament hereby revoking and making void all other wills by me at any time made.
Item 1st: I direct that all my just debts be paid as soon after my death as possible, out of any monies that I may die possessed of, or that may first come into the hands of my executor.
Item 2nd: I give and bequeath unto my wife Avarilla Link the right and use of my land and possession with all its appurtenances so long as she may live with all of my estate personal and perishable, to use, benefit and disposal during life.
Item 3rd: I give and bequeath unto my Daughters Sarah and Martha Link each twelve dollars to be equal in distribution to those of my other children who have become of age.
Item 4th: I give and bequeath to my son Bird [sic] Link twelve dollars and equal to those of my other children. Also I give unto him one dark Bay horse Colt one year old.
Item 5th: It is my will and desire that at the death of my wife Avarilla Link that all the property she may leave at her death, to wit: land, negroes and perishable, to be sold on twelve monts [sic] credit with the proceeds thereof to be equally divided between my children, to wit, Mary Matthews, Elizabeth Moore, Sarah Link, Frances Weaver, Margaret Bailey, Samuel Link, Martha Link, Avarilla Foster and Bird Link and their heirs, further I give and bequeath unto my grand children Mary Ann Wood, Elizabeth Ann Humphreys, Solomon B. Humphreys, Saml. Humphreys, Avarilla and Harriet Humphreys one eleventh part of the above named property.
Item 6th: It is my will and desire that if case any of the afore named grand children should die before they become of age or marry that their proportionable part of the estate go to the Brothers and sisters of said deceased.
Lastly. I do hereby nominate and appoint my son Samuel Link and Crowder Holloway my executors having full confidence in the integrity of my executors, that it is my desire that they do not be required to give any obligation for their faithful discharge of duty in transacting the business of my estate. I witness thereof I do to this my last will set my hand and seal this 6th day of July one thousand eight hundred and thirty nine.
