He owned ships,probably inherited from his father, traded with Holland, England, andBrazil. He was a member of house of Burgess 1658, 59, 60, & 63. He wasSpeaker of the House of Burgess 1658-60 & 63. He was a member of HisMajesties Council. In 1660-61 was appointed with Sir William Berkley andothers to act during recess of the Assembly. He appeared in behalf ofhis sons, John and Henry relative to 15,500 acres of land in WestmorelandCo., Virginia on 4 April 1671.: !He came to America in his own ship, in1637, with his wife Elizabeth and sons, William and Walter and four otherpersons. For this he received 400 acres of land. Later the same year hereceived an additional grant of 250 acres of land on the AppomattoxRiver. In 1649 he was granted 813 acres of land on the Southerly side ofthe Appomattox River, in Charles City Co., Virginia. Walter was a memberof the house of Burgess 1642-1643-1651, he was also a member of the Houseof Burgess the year before his death when he was elected Speaker, whichwas declined because of business responsibilities.:

Whereas Nicholas Smithson late of the county of Franklin, deceased died intestate as it is said and you Nancy Smithson having given sufficient security, I do therefore give and grant unto you the said Nancy Smithson full power and authority to administer all and singular the goods, chattles,[sic] rights and credits of the said deceased, and to demand, collect and in a legal manner require and receive all and all manner of debt and debts, due and oweing [sic] to the said deceased and well and faithfully to dispose of the same according to Law, and lastly, I do hereby constitute and appoint you the said Nancy Smithson administratrix of all and singular the goods, chattles [sic] rights and credits of the deceased. In Testimony whereof I have hereunto set my hand and official seal at Union this fifth day of October in the year of our Lord one thousand eight hundred and forty and of the American Independence the sixty fifth.

Smithson late of the county of Franklin died intestate as it is said having at the time of her death property in this state which may be lost destroyed or diminished in value if speedy can be not taken of the same; to the end therefore that said property may be collected, preserved and disposed of according to law, I do hereby appoint Joseph Gibson administrator of all and singular the goods and chattels rights and credits which ... of the the [sic] said deceased at the time of his death with full power and authority to secure and dispose said property according to law and collect all monies due said deceased and in general to do and perform all other acts and things which ever hereafter may be required of him by law.
