1 NOTE !INDIVIDUAL GENERAL SOURCE NOTES: 1850 CENSUS-JEFFERSON CO
2 Kenny, you asked about proof that James Massey of
Jeff.Co. AL was son of Josiah (also spelled Josias)
Massey. I think a lot of weight should be given to the
books by the late Judge Frank Massey about that as he
made a lifelong study of the Massey families and that
was his main hypothesis. Many years ago, my wife and I
visited a very old lady who descended from Josiah and
she was of the view that James Maynard Massey named in
Josiah's will must have died because the land given him
under the will went to his younger brother with whom his
mother was pregnant when Josiah wrote his will.
But that only meant that they thought, or chose to
think, that he was dead or was so far removed that he
would never have any use for the land.
Here is what the will of Josiah Massey of Kent Co.MD
said: "To my son James Maynard Massey all my lands in
Kent Co. called "Forest" * * * If he dies before 21,
then to child my wife is now pregnant with" (if that
child died, the property would go to nephew Cuthbert
Hall.) Executors were his wife Elizabeth and "my nephew
Cuthbert Hall". Witnesses were Turbutt Wright, James
Spry, Stephen Giant. will written Dec. 16, 1789 proved
Jan. 20, 1790. (From digest of will etc. in Abstracts of
Kent County, MD Wills Vol. I, 1777-1816 by Christos
Christou, Jr. etc. copied in Hall of Records, Annapolis,
MD. The will itself is in Liber 7, p.253 of will records.
It is important to note that the widow renounced her
executorship and left that duty to the aforesaid
Cuthbert Hall, who, no doubt, hoped the child would be
still-born. Note this was before that child was born.
The land would not actually have gone to the brother
until many years later when he was born and became of
age. It would not have been unlikely for James Maynard
Massey to go west with close relatives when he was a
late teenager as so many did and that he didn't write
home often if at all. They may have known very well
that he wasn't dead, but knew it was unlikely that he
would come home and use the land. Something of the same
thing happened to my William Pullen who is buried in
Jeff. Co. His father left him none of his land and only
left him his Bible and another book...something that
could either be sent to him or he could take back with
him. The land went to his sisters who were there (in
VA). Somebody in SC might as well be dead so far as
land in MD was concerned and would be natural for the
mother and the nephew-executor to see that it went to
the one who was there and needed it.
I also was impressed by the information that Judge
Massey had about Robert Allen Massey and his children.
Uncle Bob, whom I knew, was the son of Thomas Allen
Massey, son of James and Mary who had died. Three of
the Massey children married Shackelfords. I think that
Judge Massey had corresponded with someone from the LA
branch long before my time, at a time when people living
knew more (personally) than they do today.
